Terms and Conditions for SafeDrive Guardian

Please read these Terms and Conditions (“Terms”) carefully before using the SafeDrive Guardian mobile application (the “Service”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
1. Acceptance of Terms
By downloading or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Nature of the Service
SafeDrive Guardian is a tool designed to assist parents in encouraging safe driving habits. It is not a substitute for attentive driving, parental supervision, or driver education. The app acts as an aid to reduce distractions but does not guarantee the safety of the driver or passengers.
3. Disclaimer of Warranties & “As-Is” Service
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that:
The app will accurately detect speed or location at all times.
The app will successfully block all third-party applications in every instance.
The Service will be uninterrupted, timely, secure, or error-free.
4. Limitation of Liability (CRITICAL)
To the maximum extent permitted by applicable law, SafeDrive Guardian, its developers, and affiliates shall not be liable for:
Vehicle Accidents: Any traffic accidents, collisions, injuries, fatalities, or property damage occurring while the Service is in use. The driver remains 100% responsible for the safe operation of the vehicle at all times.
Mobile Device Issues: Any technical issues, hardware malfunctions, battery depletion, or software conflicts caused by the Service (including “fail-safe” modes or app shielding).
Emergency Situations: Any inability to use the mobile device during an emergency due to the app’s restrictive features. Users are encouraged to use the “No Drive Mode” request or emergency bypass features provided by the OS.
Third-Party Actions: Any unauthorized access to a device resulting from a user’s failure to secure their SSO/OTP login credentials.
5. User Responsibilities
Parents: You are responsible for configuring restrictions appropriately and discussing app functionality with your child.
Child Users: You must comply with all local traffic laws. You must not attempt to circumvent or “hack” the Service’s restrictions.
Compliance: Users must ensure that the use of this app complies with all local privacy and surveillance laws in their jurisdiction.
6. Subscription and Billing
All purchases are processed via the Apple App Store or Google Play Store. We are not responsible for billing errors or refund disputes, which must be handled through the respective app store platforms.
7. Account Termination
We reserve the right to terminate or suspend access to our Service immediately, without prior notice, for any breach of these Terms, including GPS tampering or unauthorized attempts to uninstall the Child App.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of any significant changes by posting the new Terms within the application.
